    European Court of Human Rights

    On the 20th of November 2003 Aleksey Pichugin defense lawyer filed an appeal to the European Court of Human Rights. The appeal was caused by Prosecutor Generals refuse to allow the immediate medical examination of their client and by „refusal in immediate medical assistance to Pichugin“.

    On the 30 of March 2005 defense lawyer Ksenia Kostromina made the following statement: „We are sure that we have all the grounds to appeal to the European Court of Human Rights with an additional complaint to substantiate the infringement of Pichugins right of a fair trial“.


    Ksenia Kostromina had explained the fact that certain hearings were held in camera due to classification of a portion of the case file as secret. The defense lawyer reminded of the fact that the Defense „more than once petitioned for the open trial as a whole. Only those parts of the trial remain closed when the public prosecutors examine the documents classified as secret“.

    She also emphasizes that the Defense attitude has found overall confirmation in Resolution of the Parliamentary Assembly of the Council of Europe of 25 January, 2005 that reads: „The Assembly therefore, in general terms: urges the competent authorities to ensure in particular that only those parts of the trial against Mr. Pichugin that are directly linked to information for which there is a legitimate need for security remain closed to public scrutiny, in view of the importance attached by the European Convention on Human Rights to the principle of open court hearings“.

    However, none of the defense lawyers’ appeals concerning the hearing of the case in the open trial has been satisfied. Ksenia Kostromina explains: „No information classified as „secret“ was examined during our court session. Nevertheless, the proceedings have been held in camera. It is evidently the infringement of Pichugins right of a fair trial. It must be the public hearing that is open to any person who is interested in this criminal case“.
