    Shohin Dmitry Eduardovich | 22 Jan 2007

Since September, 19, 2006  the head of the organizational methodic administration department on securing of public prosecutors participation in the criminal cases consideration by courts. He became well-known after his participation as a public prosecutor in Michail Khodorkovsky and Platon Lebedev trial, abounding in defects of proceedings and violations of human rights.

Dmitry Shohin  is the only public prosecutor to whom a Medal of Honor was awarded for his work. He was put forward for the decoration in 2004 by the Prosecutor-General Vladimir Ustinov, and an appropriate edict was signed in December of the same year by the president Vladimir Putin. By that time Michail Khodorkovsky and Platon Lebedev trial had been in full swing. Thus, one could suppose that the public prosecutor got his Medal for the previous case of the «Yukos» shareholder Vasily Shakhnovsky: in winter 2004 Dmitry Shohin tried to achieve for him in the Meshansky court of Moscow an accusatory sentence (he was charged with «tax evasion by a physical body»). After this case the public prosecutor Shohin changed his mayors shoulder strap at once for colonels ones.

The public prosecutor was also a success to play an important role in a well-known case of «Tri kita» («Three whales»). In 2003 Mr. Shohin supported the prosecution in the trial on the Ministry of Internal Affairs investigator Pavel Zaitsev, committed the offence in giving instructions about the search at the suspected in a large-scale smuggling of furniture, delivered to the trade center «Tri kita». In September, 2002 the judge of the Moscow City court Marina Komarova passed the acquittal to the investigator, however nearly six months later this decision was repealed by the Supreme court by the presentation of the General Prosecutors Office, and the case was returned to the Moscow City court to another judge, Olga Kudeshkina. According to her words, in the course of the retrial there was exerted an unprecedented pressure upon her and the two elderly assessors in a Peoples court from the direction of the public prosecutor Dmitry Shohin and the president of the Moscow City court Olga Egorova.

«The public prosecutor, — the judge Kudeshkina had told, — began to do everything to derange the trial. First, he tried to make the court to keep within the tough bounds  what questions to ask, and what not to ask. And then, he, groundless, wanted to except me, the assessors in a Peoples court, the composition of the court, humbled and insulted us. The both assessors in a Peoples court didnt bear the pressure, submitted disqualification of selves, and the one of them even had to consult a doctor». However, Mr. Shohin himself denied all this, stated that the judge initially was biased, that «not the investigator Zaitsev must be put into prison, but the smuggler Zuev». However that may be, the case was taken away from the judge Kudeshkina, passed it to her colleague Sergey Markov, who in autumn 2003 put the defendant Zaitsev on probation for two years with a period of probation for one year, made in the sentence an unprecedented mark that the convict can continue to work as an investigator. What he exactly does, as before conducting cases about smuggling.
